5. User Conduct

You agree not to:

• We do not guarantee the quality, availability, or pricing of products from manufacturers
• All transactions and agreements between you and manufacturers are separate from these Terms
• We are not responsible for any disputes between you and manufacturers
• You are responsible for conducting due diligence on any manufacturer before engaging in business

8. Design Tools and Services

Design tools and services provided on the Platform are for your use in creating your brand. You are responsible for ensuring that:

• Your designs do not infringe on third-party intellectual property rights
• Your designs comply with all applicable laws and regulations
• You have the right to use any content incorporated into your designs

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted or error-free
• Defects will be corrected
• The Platform is free of viruses or other harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATING COSMETICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
